1. Conclusion of contract
Die 2bePUBLISHED Internet Services GmbH with company number CH-170.4.008.276-0 and headoffice in Hinterbergstrasse 24, in 6330 Zug, Switzerland offers with its website ALPINRESORTS.com, international online ski hire. The rental contract is made between the customer making the reservation and the respective sports shop from which the equipment is rented. The 2bePUBLISHED Internet Services GmbH takes over the online ski rental fee collection for the retailer and forward it to him. Any claims arising from the use of the equipment rented should be addressed to the respective sport shop. The rental takes place solely according to the terms and conditions below.
The client accepts fully, that 2bePUBLISHED Internet Services GmbH reserves the right, in case of problems with the booking software, to cancel broken bookings within 3 workdays that:

2. Lease rental charges
The cost of the hire is set by the category of equipment the hirer booked and the chosen term of the hire according to our hire prices displayed at stage 3 of our website's "booking" section. Our prices are tax inclusive, at the rate applicable when booking is placed.
To compare the rental price, ALPINRESORTS shows you the euivalent of the price in CHF and GBP, by using the current exchange rate. The amount of your booking will be debited in euros. ALPINRESORTS has no influence on the exchance rate and/or expenses used by your bank at the time of booking and assumes no liability.

3. Payment
The rental amount can be paid by credit card, paypal or direct debit. There are two methods of payment:
100% online payment: In this case the entire amount is paid online.
35% Down payment.: In this case 35% of the rental amount is paid online, whereas the balance has to be paid right in the sport shop. Following amounts are exepted from this payment method and have to be paid entirely online:

3.1 Handling charges
In addition to the rental price there is a handling charge between € 1,- and € 3,- according to the booking amount.
- For a booking amount up to € 30,- the handling charge is € 1,-
- For a booking amount of € 31,- up to € 50,- the handling charge is € 2,-
- For a booking amount with more than € 50,- the handling charge is € 3,-
With the completion of the booking, the customer confirms the correctness of his personal data to be used for professional adjustment of the rented equipment. The customer must not change the setup of the equipment. The booking is validated for the customer when the online payment is made and the booking confirmation is received; for the rental shop it is validated when the booking confirmation is received.

4. Cancellation/withdrawal
ALPINRESORTS offers a simple and non-bureaucratic handling for booking changes and cancellations. The amount due to the customer will be promptly refunded to the credit card or bank account. A cancellation of the booking in writing (via mail or email, see imprint) to the following conditions is possible:

4.1 Conditions when choosing the cancellation cover
With ALPINFLEXI the customer has the option of withdrawing from the rental contract at a favourable price. This can be achieved by paying, in advance, a deposit to the tune of an additional 5% of the rental price, provided valid reasons for cancellation are presented. When choosing ALPINFLEXI, the cancellation fee will not be cleared, but the previously paid deposit will simply be forfeited. The difference between the previously paid sum and the cancellation fee will be refunded to the customer immediately.
Additionally the customers receives the full amount of the booked insurance (ALPINSAFETY) according to the number of skiing days left. The handling charge can not be refunded.

4.2 Conditions without choosing the cancel protection

If the cancellation is done up to 10 working days before the first day of rental, a cancellation fee by 15% of the booked equipment will be deducted .

If the cancellation is done between 9 to 3 working days before the first day of rental, a cancellation fee by 25% of the booked equipment will be deducted.

If the cancellation is done by 2 or less working days before the first day of rental, a cancellation fee by 35% of the booked equipment will be deducted .

4.3 General
-
No refund of the rental price can be guaranteed if the winter sport equipment is received late on the part of the customer, or if it is not received at all for any other reason. The same is true if the customer returns the ski or snowboard equipment to the rental company early. A cancellation from the day of rental is only possible due to sickness or an accident.

In the case of sickness or an accident of the customer during the rental period, the following arrangements are valid, only on presentation of a doctor’s letter.

a refund of the rental price is only possible if the rented equipment is returned to the rental company immediately after the onset of injury or illness.

if point 1) is satisfied, the excess rent which has been paid will be refunded from the date issue of the doctor’s letter onwards.

No refunds are available without a doctor’s letter.

As soon as ALPINRESORTS is informed of a case and points 1) and 2) have been satisfied, the excess rent which has been paid will be transferred immediately.

5. Collection and return of equipment
The customer must present both a form of official photo identification (e.g. passport or driving licence) and their booking confirmation in the rental shop and agree to a copy of the identification being made. The equipment can be picked up from the rental shops in France after 18.00h and from the rental shops in the other countries after 15.30h on the day before the first day of the rental period. The ski/snowboard equipment must be returned before close of business on the last day of the agreed rental period. In the case of the ski/snowboard equipment being used for longer, the difference between the actual period of rental used and the period of rental reserved and paid for will be calculated and will be payable on site.

6. Exchange
A replacement for the rented sports equipment is possible at any time. If sports equipment of a higher category is taken in replacement, a surcharge is payable, in accordance with the price list. No money will be refunded in the case of replacement equipment from a lower category.

7. Usage
The customer is responsible for the rented sport equipment and should only use it with care, according to its function and operating conditions. If the sport equipment is already defective when it is rented out, the rental shop can exchange the sport equipment or cancel the contract if it cannot repair the defect. Passing the equipment on to a third party is not permitted. The customer must ensure that the skis are only put down singly and separate from each other, or stored in ski safes. Overnight, sport equipment should be stored in a locked ski room at the accommodation or in a locked vehicle. Rented sport equipment is not insured if no insurance policy is taken out by the customer. In the case of theft, breakage or damage due to improper use or infringement of the imposed duties of care, the customer is responsible for repair costs or replacement value. Different conditions are valid choosing ALPINSAFETY siehe Punkt 9.

In the case of theft, the customer must report to the appropriate authorities within 24 hours and report the theft demonstrably and promptly to the rental shop.

9. Insurance - ALPINSAFETY
In cooperation with the ELVIA insurance company, ALPINRESORTS offers a powerful insurance. ALPINSAFETY provides insurance protection against:
Damage and repair of skis/boards
Theft of skis / boards
cost of transport to hospital, search and rescue costs
covers all customers within this booking

10. Privacy
Personal data entered into this website will be processed and used exclusively for processing your requests and for online reservations., in accordance with effective national and European regulations (data protection). The permanent saving and use of details for marketing purposes only takes place with your explicit permission (in the course of rental registration, ...). This permission can be revoked for free at any time, e.g. by email to info@alpinresorts.com. ALPINRESORTS protects the confidentiality of your details and will not sell, hire or make it available to third parties.

11. Place of jurisdiction
Swiss law presides over and Swiss national courts are exclusively responsible for all legal disputes in connection with or in relation to online bookings via ALPINRESORTS. ALPINRESORTS's liability does not extend beyond the reservation made with the company.
